Continuing the CuArb Lent series of lectures and seminars on various aspects of international arbitration, featuring speaker Dr. Velimir Živković.

The Basketball Arbitral Tribunal (“BAT”) and its default mode of 'ex aequo et bono' (from fairness and conscience) decision-making offer a fascinating, if largely underexplored, example of creation of transnational law through arbitration. Starting some 20 years ago, BAT has been a success story in developing a precedent-based jurisprudence. Through creating principles of transnational basketball law, BAT provides both unique insight into what ex aequo et bono means in practice and how transnational legal orders are created.
